If you are dissatisfied with a decision made by Svenljunga Municipality, you often have the right to appeal it. In Sweden, there are two different ways to appeal a municipal decision, depending on the type of decision it is.

1. Administrative Appeal (Förvaltningsbesvär)

This type of appeal applies to decisions that affect you personally, such as a rejected application for a building permit, social assistance, or a school placement.

  • Who can appeal? Only the person directly affected by the decision.
  • Timeframe: You must submit your appeal within three (3) weeks from the day you received official notification of the decision.
  • How it works: You send your appeal to the municipality. The municipality will first review your appeal to see if the decision can be changed in your favor. If they choose not to change it, they are legally obligated to forward your appeal to the Administrative Court (Förvaltningsrätten) for an independent review.

2. Legality Appeal (Laglighetsprövning eller Kommunalbesvär)

This type of appeal applies to general decisions that affect the municipality as a whole, such as decisions made by the Municipal Council (Kommunfullmäktige) regarding taxes, local regulations, or budgets.

  • Who can appeal? Any registered resident of Svenljunga Municipality. You do not need to be personally affected by the decision.
  • Timeframe: You must submit your appeal to the Administrative Court within three (3) weeks from the day the decision protocol was published on the municipality's official digital notice board (anslagstavlan).
  • How it works: The court will only assess whether the decision was made legally (e.g., if the municipality exceeded its authority or broke procedural rules). The court will not judge whether the decision was a "good" or "bad" idea politically.

How to Submit an Appeal

If you wish to appeal a personal decision (Administrative Appeal), your appeal must be in writing.

Your letter must include:

  • Which decision you are appealing (include the case number/reference number).
  • Why you believe the decision is wrong and how you want it changed.
  • Your name, personal identity number, address, and phone number.
  • Your signature.

Submit the letter or email directly to the municipal board or department that made the decision. If you need help writing your appeal, the municipality's administrators are obligated to assist you. Call us at 0325-180 00 or send an e-mail to kommun@svenljung.se and we will help you.
